acquired from the United States, under the provisions of said act, more than

(10) Proof Required Under Homestead Acts May 20, 1862 and June 21,
1866. –
We,
Daniel Pennie & Peter Pennie do solemnly swear that we have known Thomas
Pennie for over 10 years last past; that he is the head of a family consisting
of five children and a citizen of the United States; that he is an inhabitant
of the Lots 1 2 & 3 of section No. 11 in Township No. 126 of Range No. 37
and that no other person resided upon the said land entitled to the right of
Homestead or Pre-emption. That the said
Thomas Pennie entered upon and made settlement on said land on the 28th day of
August, 1865 and has built a house thereon of logs two stories high 18 by 22
feet with good shingled roof, good floors, doors and windows that he first built a sound block house 16
x 22 feet in which he lived until the new home was finished and has lived in
the said houses and made it his exclusive home from the 28th day of August,
1865, to the present time, and that he has since said settlement ploughed,
fenced and cultivated about 16 acres of said land, and has made the following
